We Will Protect Your Rights To Paid Leave

Under the federal Family and Medical Leave Act (FMLA), most employers must provide their employees with unpaid leave for health care reasons, to aid a family member or for the arrival of a new child. Both employers and employees have certain obligations under FMLA.

Some employers, however, refuse to grant time off because they lack knowledge regarding the law or misinterpret its provisions. In other cases, the employee fails to properly document the reason for the requested leave time, leading the employer to refuse leave.

Understand Your Rights And Take Action

If your employer has failed to grant you leave for a valid reason, or has terminated you because you insisted on taking the leave you are entitled to under FMLA, you have rights. In some cases involving FMLA violations, employees are entitled to compensation, restoration of lost benefits and/or reinstatement.

DeAngelis, Dastur & Associates, P.C., in Pittsburgh is an experienced employment law firm. If your case has merit, we can represent you in an effort to secure your rights and other remedies available to you under the law.

According to the FMLA, employers must grant an employee up to 12 weeks of unpaid leave during any 12-month period:

  • For the birth and care of a newborn child of the employee
  • When an employee adopts a child or takes a child into foster care
  • To care for a spouse, child or parent who has a serious health condition
  • When an employee is unable to work because of a serious health condition

How We Can Help

Our firm can take legal action to secure your rights. Often, this involves filing suit in federal court, followed by mediation. In other cases, we can represent you at trial.

If you become completely unable to work due to illness or disability, you may have other options as well. We can represent you so that you can get the workers’ compensation benefits you deserve or help you qualify for Social Security Disability benefits.

DeAngelis, Dastur & Associates, P.C., will use the law to help you get the medical leave or other benefits you are entitled to.
